Terms and Conditions – Azur Holiday Rental

By booking your holiday accommodation with Azur Holiday Rental, you agree to be bound by the following Terms & Conditions, including our Privacy Policy. These Terms & Conditions may be revised from time to time, and updates will be posted on our website. Revised terms take effect once posted.

Noosa Council Code of Conduct

All holiday guests must abide by the Noosa Council Code of Conduct for Guest Behaviour, which is designed to promote peaceful enjoyment for both holidaymakers and residents. This code includes, but is not limited to:

  • No excessive noise: Guests must respect the peaceful nature of the surrounding community and keep noise levels to a minimum, especially after 10 pm.
  • Respect for property: Guests must take care of the premises and ensure no damage is caused during their stay.
  • Compliance with local laws: Guests must comply with all applicable local regulations, including waste management and parking restrictions.

Failure to comply with the Noosa Council Code of Conduct may result in immediate eviction from the property without a refund, as well as potential penalties imposed by local authorities.

Accommodation Use

  • Guest accommodation is for residential purposes only.
  • Guests have 24 hours from their arrival to raise any issues with the property. After this time, the property and its condition are considered accepted.
  • The premises are let to accommodate only the number of people specified in the booking for the specified period. Overloading will result in extra charges and potential cancellation.

Parties and Functions

  • Functions and parties are strictly prohibited. Any function or party will incur a minimum fee of $300, which is non-negotiable and will be debited from your nominated credit card. Additional charges for cleaning and replacements may also apply.
  • Respect for the premises, our reputation, and the consideration of neighbours must be maintained at all times.
  • If we are called out after hours for a noise complaint, a $300 fee will be charged.

Property Descriptions

  • We aim to provide accurate property descriptions. However, no responsibility is accepted for any misleading descriptions in our materials.
  • No refunds or claims for compensation will be considered for changes made to properties before updates are reflected on our website or holiday brochure.

Booking Fees

  • All bookings attract a Booking Fee ranging from $40.00 to $80.00.

Owner Decisions and Cancellations

  • We are not responsible for decisions made by property owners (e.g., sale, alterations, or withdrawal from the rental pool) that may affect your booking. Every effort will be made to find alternative accommodation if necessary. If a booking is cancelled by the owner, all deposits will be refunded.

Deposits and Rate Increases

  • Deposits are accepted based on the rental fee quoted, which may increase or result in cancellation. Increases apply unless payment is made in full at the time of booking.
  • If a guest cancels their booking, three months’ notice is required for a refund of the deposit, less a $100 cancellation and handling fee. If cancelled within three months, the deposit will only be refunded if the property is re-let. A $50 cancellation fee applies, plus any shortfall in re-let charges.

Payments and Bond

  • A deposit of at least 30% of the rental fee must be paid at the time of booking unless other arrangements have been made. The balance is payable before arrival. We accept BC/MC/VC, cheque, or direct transfer.
  • A current credit card must be provided as security and bond for the property. If no card is supplied, a $500 bond must be left.
  • Credit card payments attract a 1.5% surcharge.

Check-In/Out Times

  • The premises are available from 2 pm on the day of arrival and must be vacated by 10 am on the day of departure. Failure to depart on time without prior arrangement will incur a charge of $50 per hour past 10 am.
  • Early check-ins and late check-outs may be available on request, except for one-night stays, with additional fees potentially applying.

Cleaning and Linen

  • Guests must leave the premises in a clean and tidy state upon departure. Additional charges apply for extra cleaning, excessive garbage removal, or if guests fail to provide their own linen where required.
  • Rubbish days are Wednesdays, and guests must put out bins for collection.

Damage and Loss

  • Guests are responsible for loss or damage to fittings, fixtures, and items on the premises, whether accidental or otherwise. Lost keys must be reported and paid for by the occupants.
  • Damage or loss discovered after checkout will be charged to the credit card on file.

Parking

  • Guests may only park in specified areas.

Pet Policy

  • In Pet-Friendly houses, pets are not allowed on carpeted areas, furnishings, or in bedrooms. No more than two pets are allowed. Pets are usually restricted to outside areas, and pet droppings must be properly disposed of. Failure to comply with these conditions incurs a $300 penalty.

Smoking

  • Smoking inside the premises is prohibited. A $250 fine applies for smoking indoors.

After-Hours Services

  • Lock-outs after hours incur a $150 call-out fee.

Termination of Tenancy

  • Any breaches of these Terms & Conditions, the Noosa Council Code of Conduct, or failure to comply with the Manager’s directions will result in immediate termination of the tenancy, with no refund for unused time.

Tariffs and Errors

  • Tariffs are current as per the tariff sheet, brochure, and website, and are subject to change without notice. No responsibility is taken for errors or omissions.

Neighbour Consideration

  • Guests must respect the quiet nature of the village and their neighbours. Noise pollution is an offence, with restrictions imposed by the police.

Unexpected Issues

  • While we strive to provide a seamless experience, unforeseen issues (e.g., electrical malfunctions or severe weather) can occur. These will be addressed promptly, but no compensation will be provided for such problems unless deemed critical by the manager.

Website Use

  • Use of the Azur Holiday Rental website is subject to terms and conditions regarding content accuracy, errors, and liability. The website is provided “as is,” with no warranty of fitness for a particular purpose. Changes and updates can be made without notice.

Disputes

  • Any disputes will be resolved according to Queensland law, and guests agree to arbitration in Queensland, Australia.
